TOS
Hello! Thank you for visiting my commission page, and welcome to my Terms of Service page ( TOS)As an artist/ designer, it is in my best interest to create works that fulfill every customer's desired outcomes. It is essential for every customer who is working with me to read the TOS thoroughly
To ensure that the customer understands what to expect, and what I expect from the customer.By commissioning me and using my service you and I acknowledge and accept to be bounded by the terms of service. If found that the TOS has been breached I have full rights to cease the service. Breaking the TOS will come with consequences such as being blacklisted etc.PLEASE BE AWARE: English is not my first language, and I personally have a hard time understanding words/ sentences, etc. Please be patient with me If I misread/ misinterpret your message.
General TOS
I have the right to refuse your commission for any reason.
I can pause the commission for any ill behavior during interaction/ revision.
I am to keep hold of the rights to my work, this includes and is not limited to self-promotion, reproduction, and copying of the artwork with contexts.
Work from me will NOT be allowed to be used in/ relate to NFT in any shape or form
Work from me will NOT be allowed to be used to feed an AI or be used in AI in any shape or form
You must not commission me on behalf of someone who has been blacklisted.
I hold the rights to any unused designs that were created during the commission process. The unused design can be repurposed and used in any context
Customer have the right to...
Use the work for PERSONAL USE
Share/Post/Repost my work with the proper credit ( link or @ )
Customer does NOT have the right to...
Use the work for commercial use
Claim the work as their own, copy or heavy reference my work.
Remove signatures that are placed on the work
Modify my artwork without consent
Use an unused design that was part of the design process in any context.
Payment
Payment is to be made via PayPal only.
The currency is USD and NZD
The price of the commissions is in USD, therefore if the customer were to pay in NZD, they must first convert the USD price to NZD.
At least 50% of the quoted price must be sent before I can start the commission
100% of the payment must be made before the customer can receive the final artwork from me.
100% payment can be made at any stage of the commission process before the delivery of the final work.
A payment plan can be discussed however the rule above still applies to the payment plan ( the commission will not start until %50 of the payment has been paid)
If a customer wishes to get commercial rights to my work, they must contact me or let me know at the beginning. Commercial rights can be a flat fee or % of overall sales.
Cancelation
If a customer cancels a commission after payment, there will be no refund.
The customer will then be given the most recent progress of the commission.
If I cancel a commission after the payment due to any issue, the customer will be fully refunded.
References
For any work, whether it is an illustration, character design, or branding/ logo, it is the customer’s responsibility to provide me with a sufficient reference. This helps with the flow of work but also reduce the number of revision needed during the commission process.
It is crucial for customers to have a clear idea of what they want from me.
The form/ information that is required is written on the contact page.
Extra payment may be added to the final quote if there are insufficient references. However, the customer will be notified and will be given advice on how to provide me with proper references
Commission process
The commission process usually starts with a discussion around the information you have given me. It is crucial for me to go over information as it helps me double-check each detail to reduce the potential misinterpretation of the breif/ form given to me by you.A deadline can be set with the discussion with me, however, an artwork can not have less than a week deadline. Certain commissions will take up to months and a year.I currently do not have a number of specific revisions allowed. However, at the least, you will be provided with 4 revisions during the process which are: sketch, linework, colour, and final touch.During Revision, it is important for you to look at each detail thoroughly and raise any concerns, changes, etc. Here are some expectations on what I am looking for during the 4 revisions you provided.Sketch: comment on Pose, expression, background, colour ( if I have placed a rough colour into the sketch)
Line: comment on missing or wrong details, any unsatisfaction on the pose, expression, anatomy, etc
Colour: Comment on colour, lighting, shadow, etc
Final touch: small details, colour, lighting, shadow, effect, etcThis may be different for commissions such as logo design, character design, reference sheet, animation, etc.WHAT'S MOST IMPORTANT IS >> Anything that you have approved of, or something that could have been changed in the way back in the past will cost you extra money to change.COMMUNICATION IS KEY. You are more than welcome to ask for updates and you are very welcome to ask me any questions. Please do let me know if communication is a difficult task for you so I can work with your needs.
